The play was inspired by the case of Madeleine Smith (1835–1928) who was accused of murder in Glasgow in 1857. The case was “not proven” under Scottish law. However the play is set in New York in the present (1930).

A film version of the play was made in 1947 starring Hedy Lamarr.

A film version of the real case (under the title “Madeleine”) was made in 1949, directed by David Lean and starring his then wife Ann Todd.
